What to Do if You Get a DWI in Dallas County
Dallas DWI charges are serious. There are a number of things you need to do and a number of important things you need to keep in mind if you are charged with Driving While Intoxicated. The way you handle your Dallas DWI could have long-term consequences for you. Under Texas Drunk Driving Laws, your DWI could be treated as either a misdemeanor or as a felony. The circumstances of the incident and your prior record will have a large influence on how your Dallas DWI is treated. In general, your first DWF Drunk Driving Offense will be treated as a class B Misdemeanor.
In the State of Texas, the DWI Laws state you are guilty of DWI if you:
· Blow above 0.08 on the Breathalyzer
· Test above 0.08gm/100 ml blood
Dallas DWI offenders who think they should refuse the Breathalyzer and insist that they are given the blood test are making a mistake. The logic behind this is that it will take them longer to get it set up and by that time, your blood alcohol levels will have fallen. Don’t do this. Texas Drunk Driving Laws contain an implied consent clause. This means that any person who has been granted a drivers license has given implied consent to provide a blood or breath specimen if arrested for a DWI. This means that legally, you do not have the right to refuse the breath test or to consult an attorney before submitting to the test. If you do refuse the test, your license is automatically suspended.
For a Dallas DWI Charge you can request a jury trial. The Prosecutor must convince all Jury members beyond a reasonable doubt that you were driving drunk. This is a large gamble. If your Attorney loses the trial, the penalty will be worse than if you accepted the DWI charge.
Keep in mind:
Avoid DWI License Suspension -You have to request a hearing in writing within 15 days of Driving While Intoxicated or your license is automatically suspended.
DWI Sobriety Test - Refusal of any sobriety test will only make matters worse for you.

Expect Multiple Fines if Convicted - If convicted of the DWI expect multiple fines, court ordered alcohol counseling, mandatory driver’s courses and community service, at a minimum.
